Rental Terms and Conditions / GTC "Backdoor Shop Rental" – Version 23.12.2025

1. Provider / Scope of Application

  1. The provider of the rental is Backdoor Shop GmbH, Dorfstrasse 164, 3818 Grindelwald (hereinafter referred to as Landlord).
  2. These General Terms and Conditions (GTC) apply to every rental of sports and equipment items by the landlord – regardless of how the rental comes about (e.g., in the shop on-site, by phone, via email, through messenger, via an online booking portal, or other digital channels).
  3. Individual agreements between the landlord and tenant (e.g., group, seasonal rentals, special rates, special times) take precedence over these GTC.

2. Contractual Relationship / Conclusion of Contract

  1. The rental contract is concluded between the landlord and the tenant.
  2. Depending on the booking method, the following applies:
  • On-site in the shop: The contract is concluded at the latest with the handover of the rental material.
  • By phone/written/online: The contract is concluded with confirmation by the landlord (e.g., written/electronically) or at the latest with handover.
  1. The landlord may refuse reservations (e.g., due to lack of availability, implausible information, security reasons). Any payments made will be refunded in this case.

3. Rental Range / Categories / Illustrations

  1. The rental range primarily includes winter sports and outdoor equipment, e.g.:
  • Ski, ski boots, poles, helmets
  • Tour skis, touring bindings, touring shoes, crampons
  • Snowboards, snowboard boots, bindings, splitboards
  • Sledges/sleds/bobs/snowshoes
  • LVS, shovel, probe
  • Clothing and accessories (e.g., jacket, pants, goggles), if offered
  1. Images/names serve to indicate the category/type and can differ from the effectively issued model; there is no claim to a specific model.

4. Prices / VAT / Payment

  1. The published prices (website/shop/poster/offer) are applicable.
  2. Prices are inclusive of statutory taxes/charges; VAT is based on applicable law.
  3. Payment is made depending on the process online and/or in the shop (cash and/or the offered payment methods).
  4. Partially used days are generally fully charged unless agreed otherwise.

5. Collection / Return / Delays

  1. The collection and return location is generally the shop of the landlord unless agreed otherwise.
  2. Standard rule (unless otherwise regulated in the shop/poster):
  • Collection on the evening before the first rental day from 4:00 PM is possible.
  • Return must be made on the last rental day by closing time.
  • A return the following day will be charged as an additional rental day (even if the return is made by 10:00 AM).
  1. In case of late collection, the tenant is urged to inform the shop as soon as possible. Reserved material will be held for a maximum of 24 hours; thereafter it may be rented out again without compensation.

6. Tenant's Duties / Care / Prohibition of Transfer

  1. The tenant uses the rental material properly, carefully, and according to instructions.
  2. The transfer to third parties is not permitted without the landlord's consent.
  3. The tenant ensures safe storage (protection against theft/mistakes).
  4. The tenant reports damages, accidents, defects, or irregularities immediately.

7. Safety-Related Information / Binding Adjustment (Ski)

  1. The tenant confirms that all safety-related information is correct (e.g., age, height, weight, skiing ability).
  2. Adjustments to safety-related components (e.g., ski bindings) may not be altered independently after handover.

8. Minors

  1. In the case of bookings for minors without the accompaniment of an adult, the legal representative is liable as per statutory provisions.
  2. The landlord may require a written consent/liability assumption.

9. Deposit / Identity Verification / Collateral

  1. The landlord may require collateral before issuance (e.g., deposit, credit card pre-authorization, ID data).
  2. Without suitable collateral, issuance may be refused.

10. Defects / Damage / Wear / Loss / Theft

  1. The tenant is responsible for the rental material as long as it is in their possession. In the event of loss/theft, the tenant is liable up to the amount of the current value (market value) as well as any potential additional costs (e.g., loss), as far as legally permissible.
  2. Damages due to improper use, negligence, or inappropriate use will be charged to the tenant.
  3. Upon issuance, visible pre-damages are documented; a check occurs at the return. Missing/defective material will be charged.
  4. Theft: The tenant must file a report with the competent authority within 24 hours and report the theft immediately (including proof).

11. Liability / Insurance

  1. The use of rental material is fundamentally at the tenant's own risk. The landlord is only liable within the framework of statutory provisions; liability for intent and gross negligence is not excluded.
  2. The tenant is obliged to have sufficient accident and liability insurance; insurance is the tenant's responsibility.

12. Withdrawal / Cancellation / Rebooking / No-Show (Variant A – slim)

  1. Up to 24 hours before the start of the rental, a reservation is generally free to modify (by phone or email).
  2. Cancellation up to 24 hours before the start of rental: Additional fee 10% of the payment made; the rest will be refunded.
  3. Cancellation within 24 hours or no-show: 100% of the reservation amount is owed; no refund.

13. Cancellation due to Accident/Illness / Bad Weather

  1. In the case of accident/illness, the difference amount of the remaining rental duration will be refunded against medical certificate; partially used days will not be refunded.
  2. In the case of bad weather or restricted/cessation of mountain railway operations, there is generally no entitlement to refund.

14. Category Change / Upgrades / Downgrades

  1. A category change is possible subject to availability.
  2. Upgrade for an additional charge according to the price list; no price reduction occurs if changing to a lower category (unless agreed otherwise).

15. Online Purchased Additional Items / Collection

Items purchased online as part of a booking process and collected on-site are generally not exchangeable or refundable after the start of the rental (except in statutory warranty cases).

16. Data Protection

Personal data is processed for the execution of reservation/rent/payment/support and only shared with service providers as necessary (e.g., payment providers, hosting, support). Details are governed by the privacy policy.

17. Applicable Law / Jurisdiction

  1. Swiss law applies.
  2. The place of jurisdiction is – as far as legally permissible – the registered office of the landlord.

18. Final Provisions

  1. Should individual provisions be ineffective, the contract shall remain effective in other respects.
